  •  Magpies Netball Membership Terms and Conditions

     

    2017 Collingwood Magpies Netball team (Club) memberships are subject to the following terms and conditions which include the Club's Privacy Policy.

     

    Upfront and monthly payment plan memberships are subject to automatic roll over each year unless members opt out by the notified deadline. See clause 6.2 for further details and terms.

     

    1. Purchase of a membership

     

    • If you are successful in your membership application, the Club will issue you a payment confirmation electronically within 5 business days. Your membership card and fulfilment package will be issued within 10 business days from 5 December, 2016. Members who join during the season will receive a membership card (or match entry ticket) prior to the next home game.
    • The Club reserves its right not to accept any membership application form in its absolute discretion.
    • All membership categories are subject to availability.

     

    1. Term of Membership

     

    • Subject to the following terms and conditions, your Club membership will entitle you to the benefits of Club membership from receipt of your membership payment to 31 October 2017.

    3.1.2     General Admission membership categories

     

    • General Admission access to matches is not guaranteed. Access is subject to capacity and you are encouraged to reserve a seat in order to guarantee entry, particularly at high demand matches. Members will be required to pay additional fees and charges when reserving a seat. Access may be gained to unreserved seating on a first-come, first served basis subject to availability and members can upgrade to a reserved seat at the venue for an additional fee subject to availability.
    • The Club may from time to time where reasonably necessary (and subject to applicable State and Territory Laws and the Australian Consumer Law) vary the terms and conditions of Club Membership. The Club will communicate any change to its membership terms and conditions via the Club membership website. Except for any rights they may have under applicable State or Territory Laws and the Australian Consumer Law, members will have no claim against the Club by reason of any change made to its membership terms and conditions. Any changes will be effective at the time of posting.

     

    3.1.2.1  Full Season General Admission

    3.1.3     Non Access membership categories

    3.2        Membership Classifications and Concessions

     

    3.2.1     Family

     

    • Family memberships are available for two adults and up to two juniors (under the age of 15 as of 1 January 2017).

     

    3.2.2     Junior

     

    • To be eligible for a Junior membership, the applicant must be 5 years of age or more and under the age of 15 as at 1 January 2017. Children aged under four at 1 January 2017 are entitled to attend matches without a Club membership, however they must not occupy a seat.

     

    3.2.3     Student 

     

    • Student concession is available to people studying full-time in 2017. Your membership application form must be accompanied by a copy of your 2017 student card or a photocopy of a stamped, receipted 2017 enrolment form from your education institution.

     

    3.2.4     Pensioner

     

    • Pensioner concession is available to people holding a 2017 pensioner concession card issued by Centrelink, the Department of Health and Community Services, the Department of Community Services or the Department of Veteran Affairs. A Heath Care or Health Benefit card will not be accepted. Your membership application form must be accompanied by a photocopy of your pension card. Pension cards must be valid for the duration of the 2017 NNL season.

     

    3.2.5     Companion card holders

     

    • Anyone holding a Government issued Companion Card is entitled to one complimentary membership for their carer.

     

    • Once you have purchased your membership, you are required to send through proof of your Companion Card and the Club will then issue you with a complimentary membership in the same membership category as the one you have purchased to allow your carer access to the games when caring for you.

     

    3.3        NNL Finals Series entitlements

     

    • Each member's access to the NNL Finals Series matches will be determined in accordance with their respective membership category and corresponding entitlements. Please refer to the terms of your particular membership for further detail. The Club will communicate information relating to members' access to NNL Finals Series matches in May 2017 should the Club be participating in the NNL Finals Series.

     

    1. Transfer of Membership Card Entitlements

     

    • Club members may transfer their membership entitlements (or tickets) to a family member or friend providing that the family member or friend is at the equivalent level of entry. If a Concession or Junior member transfers a membership entitlement or ticket to an adult, the adult will be refused entry and will have the membership card or ticket confiscated at the gates. The ticket will not be returned to the member and a replacement fee (to be advised by the Club) will apply for the issue of a new membership card.

     

    1. No Onselling

     

    • Club membership cards may not, without the prior written consent of the Club, be on sold (including via on-line auction sites) or used for advertising, promotion, fundraising or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original purchaser or any subsequent bearer. If a ticket is on sold or used in breach of this condition, the ticket may be cancelled without a refund and the bearer of the ticket may be refused admission. Penalties apply (including cancellation of any offending member's Club membership without a refund).

     

    1. Payment

     

    • Payment of your Club membership fee may be made in one of the following ways: 

     

    6.1        Full Payment

     

    • Your full membership fee can be paid via any one of the following methods: VISA, MasterCard, American Express, Diners Club, BPay, Australia Post Billpay, Cheque, Cash or EFTPOS.

     

    6.2        Payment Plan

     

    6.2.1     Upfront Payment Plan and Automatic Rollover

     

    • The Upfront Payment Plan payment will be deducted in one instalment on 21 October each year via a nominated VISA, MasterCard, American Express or Diners Club cards. Diners Club and American Express payments incur a 3.5% surcharge. Other forms of credit or debit cards will not be accepted.
    • By joining the Upfront Payment Plan, you authorise the Club to debit from your nominated credit card or debit card in amounts as advised.
    • The 2017 instalment will be withdrawn on 21 October 2016. If payment fails to transfer between institutions on 21 October 2016, further attempts will be made to clear the funds until successfully processed.
    • Members applying for the Upfront Payment Plan after the scheduled payment (21 October 2016) will have their payment deducted upon applying.
    • It is your responsibility to ensure:

    (a) The account details you have provided are correct, including notification should the expiry date change.

    (b) You have sufficient clear funds available in the nominated account on the scheduled payment date.

    • If your payment is returned or dishonoured by your financial institution, you will receive notification requesting immediate payment. Your 2017 membership will not be confirmed until payment has been processed. Any fees levied to you by your financial institution will be payable by you. It is your responsibility to ensure all contact details are correct at all times and to update them if they change.
    • If you believe that a withdrawal has been initiated incorrectly, contact our Membership Services Centre on 1300 MAGPIE (1300 62 47 43) during business hours.
    • By joining the Upfront Payment Plan you will automatically be included into an auto renewal agreement, facilitating automatic rollover of your membership from year to year until you opt out of the Upfront Payment Plan.
    • The Club will provide you with 14 days’ notice in writing of changes in the new amount of your next season’s membership prior to the payment being deducted.
    • You may opt out of the Upfront Payment Plan prior to the next annual Upfront payment being deducted by following the procedure in the updated terms and conditions and communicated to you by the Club
    • The Club will provide you with 14 days’ written notice of any changes to the terms and conditions of the Upfront Payment Plan.

     

     

    6.2.2     Monthly Payment Plan and Automatic Rollover

     

    • The Monthly Payment Plan payments will be deducted in instalments on the 21st of each month, beginning from 21 October each year via a nominated VISA, MasterCard, American Express or Diners Club card. Diners Club and American Express payments incur a 3.5% surcharge. Other forms of credit or debit cards will not be accepted.
    • By joining the Monthly Payment Plan, you authorise the Club to debit from your nominated credit card or debit card in amounts as advised.
    • The first instalment will be withdrawn on 21 October 2016, with further payments on the 21st of each following month, or the next business day if the 21st falls on a weekend. If any payment fails to transfer between institutions on the 21st, further attempts will be made to clear the funds until successfully processed.
    • On the 21st of each month all outstanding/overdue payments will be attempted to be deducted.
    • For members who apply for the Monthly Payment Plan after the first scheduled payment (21 October 2016) will have a payment or payments deducted to bring them up to date with the schedule. After this point payments will continue at each specified date (21st of each month). The final payment is march 2017.
    • It is your responsibility to ensure:

    (a) The account details you have provided are correct, including notification should the expiry date change.

    (b) You have sufficient clear funds available in the nominated account on the scheduled payment date.

    • If your payment is returned or dishonoured by your financial institution, you will receive notification requesting immediate payment. Any fees levied to you by your financial institution will be payable by you. It is your responsibility to ensure all contact details are correct at all times and to update them if they change.
    • The Club may suspend or cancel your membership if on two consecutive occasions your payment is dishonoured by your financial institution. You will be notified if we suspend or cancel your membership and your barcode will be blocked for games until the membership payments are brought up to date. Please note that at least 24 hours will be needed to reinstate your membership once payment is received. Members affected will have their seat returned for resale at each game and if their payments are brought up to account on game day, will be issued with a different seat for that game.
    • If your membership is suspended or cancelled, all membership benefits including access to Collingwood games, Collingwood functions and access to purchase NNL Finals tickets through the members presale will be suspended.
    • We refer any outstanding balances throughout the season to our collections agency for recovery. This may involve additional costs that you could be responsible for.
    • Each month, all outstanding payments will be attempted to be deducted from your nominated credit card or debit card.
    • If you believe that a payment has been initiated incorrectly, contact our Membership Services Centre on 1300 MAGPIE (1300 62 47 43) during business hours.
    • By joining the Monthly Payment Plan you will automatically be included into an auto renewal agreement, facilitating automatic rollover of your membership from year to year until you opt out of the Monthly Payment Plan on these terms and conditions unless varied.
    • The Club will provide you with 14 days’ notice in writing of changes in the new amount of your next season's membership and the amount of your monthly deduction prior to the first payment being deducted.
    • To opt out of the Monthly Payment Plan after the first payment has been deducted, contact our Membership Services Centre on 1300 MAGPIE (1300 62 47 43) during business hours. However you must complete all outstanding payments in full.
    • The Club will provide you with 14 days’ notice of any changes to the terms and conditions of the Monthly Payment Plan.

     

    1. Reserved Seat Return Program

     

    • By returning your seat for resale through the Club's Reserved Seat Return Program, you confirm your understanding and acceptance of the below Terms and Conditions of the program in addition to the membership terms and conditions. In the event of any inconsistency, the below terms and conditions apply.
    • The Reserved Seat Return Program applies to members who hold a reserved seat at Hisense Arena for Collingwood Netball Home games as part of their membership package.
    • You may give up your rights to access and use your seat at any Home game that has not been played by using one of the following methods:
      • Online, by logging into your MyMagpies Account with your membership number and password, selecting 'Return Seat' and nominating the game or games for which you wish to return your seat. This can be done at any time, up until four hours prior to the start of the game, or,
      • By contacting the Membership Services Centre on 1300 MAGPIE (1300 62 47 43) during business hours only (Monday to Friday, 8.30am to 5.00pm AEST/AEDT) at least four hours prior to the start of the game if the game is on a business day or if the game is not on a business day, by 5pm on the business day immediately prior to the relevant game.
    • Seats cannot be returned by emailing the Club membership email address.
    • Once you return your seat for any game by completing one of the methods set out above, it cannot be retrieved or accessed for use by you for that game.
    • Return credits are awarded only if the returned seat is successfully on-sold by Ticketek for any game. There is no guarantee that a returned seat will be on-sold.
    • You agree and acknowledge that:
      • your returned seat will be available for sale on the usual terms and conditions and pricing that applies at the time of sale of tickets for the relevant game;
      • the resale of your returned seat is not guaranteed and the Club and Ticketek are not responsible for ensuring the resale of your seat;
      • you cannot specify any price at which or any terms or conditions on which the seat will be resold; and,
      • you will not attempt to retrieve or access your returned seat.
    • To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), the Club shall in no circumstances be liable to you for any indirect or consequential losses or any loss (whether direct or indirect) arising out of your participation in the Reserved Seat Return Program, including (without limitation) from the resale or failure to resell your seat.
    • Credit earned on seats successfully resold may only be redeemed on the following season's membership renewal and is not transferable.
    • Seat return credits are not refundable and not redeemable for cash.
    • If your seat is successfully sold, the credit will be allocated to your MyMagpies Account within seven (7) working days after the completion of the game for which the seat was resold and you will be advised by email. If you do not have a valid email listed with the Club you will be required to contact the club to request this information.
    • Credits are only awarded for seats that are resold through nominated Ticketek outlets or Ticketek.com.au. Tickets sold or purchased for any seat through any other forum are not eligible for seat return credit.
    • Total seat return credits will be calculated and automatically credited to membership accounts at the completion of the home and away season; the total credit amount will appear on the following year’s membership renewal invoice.
    • Full list of credits applicable for the 2017 season are:
      • $10 for every resold adult and concession seat
      • $5 for every resold junior seat
    • The Club decision on issuance of seat return credits will be final and cannot be contested.
    • Any member that is financially non-compliant for the 2017 season will be unable to return their seat for resale.
    • The Club reserves the right (subject to applicable State or Territory laws and the Australian Consumer Law) to change any of the above terms and conditions by making them available on the Club's website at magpiesnetball.com.au. Any changes will be effective at the time of posting for any seats returned by a Reserved Seat member after the date of posting.
    • The Club reserves the right (subject to applicable State or Territory laws and the Australian Consumer Law) to terminate the Reserved Seat Return Program at any time. Credits will be awarded to reserved seat members for all seats returned prior to the date of termination, in accordance with these terms.

     

    1. GST and Levies

     

    • Except where expressly noted, all prices include GST and any applicable venue levy.

     

    1. Refund Policy

     

    • Subject to the Australian Consumer Law, once a membership has been purchased, memberships are non-refundable.
    • Subject to the Australian Consumer Law, there will be no refunds available if you wish to terminate your membership prior to the end of your agreement on 30 June, 2017.

     

    1. Cancellation Policy

     

    • Club memberships are valid from the date of joining until 30 June 2017.
    • By becoming a member of the Club, you agree to this term of membership.
    • In exceptional circumstances, if a member wishes to cancel their membership, the Club will advise the member to submit a written request to Membership Services via email to membership@collingwoodfc.com.au or post to PO Box 165, Abbotsford VIC 3067 for consideration at its discretion.
    • If the fulfilment items have been sent prior to the request for cancellation, the membership product will not be cancelled or refunded, subject to the Australian Consumer Law.
    • The Club reserves the right to cancel or suspend a membership without refund of any member that breaches the terms and conditions of membership. Any membership cancelled by the Club will result in consecutive years of membership being ceased.
    • The Club reserves its right to cancel a member's Club membership without a refund where that member is deemed by the Club to have breached these terms and conditions (including where that member attempts to transfer or sell their Club membership and/or associated benefits).

     

    1. Club Member Conduct

     

    • While barracking and supporting your club is a vital part of the game, offensive or aggressive behaviour (including yelling and swearing when dealing with Club staff, agents or NNL or other event staff) will not be tolerated. Club members who consume alcohol on a match day are to do so responsibly. Drunkenness will not be tolerated. The Club takes a strong stance on vilification and has a zero-tolerance for members or supporters that abuse the opposition, opposition supporters, or umpires on grounds of race, religion, gender and sexuality. Club members whose conduct in the Club's opinion breaches this clause may face penalties, including suspension or cancellation of membership without refund.

     

    1. Changes to Club membership Terms and Conditions

     

    • The Club may from time to time where reasonably necessary (and subject to applicable State or Territory Laws and the Australian Consumer Law) vary the terms and conditions of Club membership. The Club will communicate any change to its membership terms and conditions via the Club website or email. Except for any rights they may have under applicable State or Territory Laws and the Australian Consumer Law, members will have no claim against the Club by reason of any change made to the terms and conditions of Club membership.

     

    1. General Venue Rules

     

    • Club members must adhere to all rules, policy and restrictions imposed by the venues attended by the Club member including providing their bags for inspection and allowing physical security checks. All venues are smoke-free. Patrons are not permitted to bring alcohol into any venue and must adhere to strict restrictions placed on alcohol consumption in designated areas at all venues. Umbrellas are not permitted to be opened anywhere within viewing areas at any time on match day.

     

    1. Membership Cards & Tickets

     

    • Membership cards remain the property of the Club. If a Club membership card is lost or stolen, please contact the Club's Membership Services Centre on 1300 MAGPIE (1300 62 47 43) during business hours and the Club will then issue a replacement Membership card subject to receipt of the replacement card fee (as advised by the Club). The card will be replaced at no cost upon provision of a police report or statutory declaration detailing the theft.

     

    14.1      Membership Cards

     

    1. Delivery – Your Club membership card is personalised. Membership cards will be mailed out as soon as practicable after your application has been processed.
    2. Lost Cards – If you lose your membership card you will be required to present a signed original statutory declaration to the Club. A membership card replacement fee of $25 will be charged. Replacement membership cards will be mailed out to you and cannot be issued on game day.
    3. Forgotten Cards – the Club can provide you with a replacement ticket on the day for a cost of $10. If you have lost your membership card you will be required to pay the $25 replacement fee.

     

    14.2      Print your own tickets (also known as the TicketFast system)

     

    • This service is only available for members with a reserved seat at Hisense Arena or Margaret Court Arena. Log into your MyMagpies Account to print tickets. Once you have printed your ticket for a game your barcode on your membership card will be made inactive for this game. It will not be possible to reactivate your card for this game. If you lose your tickets you have the option of re-printing tickets through your MyMagpies Account. This service is only available for Collingwood home games at the Hisense Arena and Margaret Court Arena. TicketFast will close one full business day before the game. Actual closing times and dates will be announced once the 2017 NNL fixture has been released. Tickets are not available for mobile scanning.

     

    14.3      Seat forwarding

     

    • If you are a season ticket reserved seat holder, you can make your seat(s) available to family and/or friends to use on any game day. This option allows you to keep your membership card and your family/friends can receive daily paper tickets via email to gain access to Hisense Arena and Margaret Court Arena on game day. You can forward your seat to a family member or friend through your MyMagpies Account up until one business day prior to the match.

     

    1. Members' Privacy

     

    • The Club respects your privacy. All personal information we collect about you and individuals whose information you provide to the Club, such as family members, will be used and disclosed by the Club and on behalf of selected third parties in accordance with our Privacy Policy which you agree when you sign up as a Club member. You agree you are authorised to provide the information you give us about others. This may include for promotional and direct marketing purposes and other uses and disclosures as specified in our Privacy Policy which is available at magpiesnetball.com.au/privacy or at the front desk of the Holden Centre or by calling 1300 MAGPIE (1300 62 47 43) during business hours. Your personal information is kept securely and confidentially. Although you may choose to only provide us with certain information, please be aware that this choice will affect the type and quality of service we provide to you and it may also result in delays. Our Privacy Policy explains how to request access to or correction of the personal information the Club holds about you and how to make a privacy complaint and how the Club handles complaints.

     

    1. Telephone and Internet Renewals

     

    • Members may purchase and renew their Club membership over the telephone or online. By purchasing or renewing over the telephone or online, you accept these terms and conditions of Club membership (as amended by the Club from time to time).

     

    1. Home games
    • Home games not played at Hisense Arena or Margaret Court Arena: You acknowledge that the Club may, in its sole discretion, play any game scheduled by the NNL to be played at Hisense Arena or Margaret Court Arena, at another venue including a venue which is the home ground of another NNL Club. The Club may, at its absolute discretion, provide some compensation for any benefits foregone in these circumstances.

     

    1. Reserved Seats and changes

     

    18.1      Seating preferences

     

    • Seating areas at Hisense Arena and Margaret Court Area are subject to change and are made upon consultation with the venue.
    • The Club is unable to, and does not, guarantee that your seating preference will be able to be accommodated.

     

    18.2      Group Seat Requests

     

    • If you wish to be seated with specific members or if you are introducing new members who you would like to sit with, all forms must be submitted together by email, post or delivered personally to the Club. You should nominate a Group Leader for your seating request that should be used by all people wishing to sit together.

     

    18.3      Request processing

     

    • All change/upgrade and new seat requests are to be submitted via MyMagpies Account and are subject to availability. The Club is unable to, and does not, guarantee any seats will be available. You will be notified of the outcome of your application as soon as possible.
    • New seat requests are processed in order of date received. If your preference is unavailable, you will be seated in the best available seat at the time of processing.
    • Members wishing to apply for new seats can do so via their MyMagpies Account. Simply login using your Member ID and Password and select the seat you want from the Interactive Seat Map.
    • If your preferred seat is not available you will need to wait until Monday 5 December, 2016 at which time you will be able to review any unallocated seat/s through the Interactive Seating Map.

     

    1. 2017 Bring a friend for FREE offer

     

    • Upon the release of the 2017 NNL Fixture, the Club will confirm selected games in which members can bring a friend for free. Full terms of the offer are listed below:

     

    • The free ticket will be a general admission ticket. General admission entry is subject to capacity.
    • The ticket cannot be upgraded to a reserved seat or access any of the Club reserved seating areas.
    • Members will receive one redemption ticket with their membership pack. Lost/misplaced tickets cannot be replaced.
    • Members can only use their free ticket for one of the nominated games.

    • The Club has the ability to introduce new promotions and offers to members. Any member who has purchased prior to these offers will not be able to request a refund for membership or have the promotion apply to their membership.

COMPETITION

  1. This document contains the terms and conditions of entry (“these terms”) into the 2017 Magpies Netball Member Survey competition (“Promotion”) and information on how to enter the Promotion and about the prizes which form part of these terms. Entry into this Promotion is deemed acceptance of these terms. By entering this Promotion, the entrant acknowledges that they have read, understood and agree to be bound by and abide by these terms.
  2. The promoter is Collingwood Football Club Limited (ABN 89 006 211 196) of Holden Centre, Cnr Olympic Blvd and Batman Ave, Melbourne VIC 3000 ("Promoter”).
  3. Subject to the Australian Consumer Law, the Promoter may vary the terms of, or terminate, this Promotion at any time at its absolute discretion without liability to any entrant or other person. The Promoter will not award any prize if the Promotion is terminated for whatever reason. If the Promotion is not capable of being conducted due to circumstances beyond the Promoter’s control, including due to any technical or communications problems, the Promoter reserves the right to amend, suspend or cancel the Promotion.

 

DEFINITIONS

  1. In these terms, the following meanings apply in addition to terms which are defined elsewhere in these terms unless the contrary intention appears:

 

Entrant” means a person who is eligible to participate in the promotion in accordance with clause 6 of these terms.

“Financial Members" means a person who holds a current 2017 Magpies Netball membership at the time of the draw and who can only enter in their own name.

“Glasshouse” is located at the Holden Centre, Cnr Olympic Boulevard and Batman Avenue, Olympic Park, Melbourne.

"Prize" has the meaning in clause 12.

Winner” means the Entrant whose name is randomly drawn from all Eligible Entrants.

PROMOTION PERIOD

  1. The Promotion will be open from 3.00pm Australian Eastern Daylight Time ("AEDT") on Tuesday 3 October, 2017 and will continue until 11.59pm on Friday 13 October, 2017 ("Promotion Period").

    ELIGIBILITY 

  2. Entry is open to Victorian residents who were financial members in 2017 ("Eligible Entrants"), excluding employees of the Promoter, and other agencies, firms or companies (and their immediate families), who are directly associated with this Promotion.

HOW TO PARTICIPATE

  1. To participate in the Promotion and be eligible to win, an Entrant must:
    1. Be invited to enter the 2017 Magpies Netball Member Survey by the Promoter
    2. Visit the entry page and complete the required fields
    3. Provide their details to go in the draw
  2. The Prize Winner will be randomly drawn at the Holden Centre, Cnr Olympic Boulevard and Batman Avenue, Melbourne, Victoria at 11.00am (AEDT) on Monday 16 October 2017. The Prize will be awarded to the first Eligible Entrant drawn. If the entry is invalid, the next valid entry drawn will win the prize.
  1. The result of the Promotion is final. No correspondence will be entered into.

 

LIMITS OF ENTRY

  1. If an Entrant is the Winner, they must consent to and licence the recording and use of their name, character, voice, image and likeness by or on behalf of the Promoter for the purposes of any promotional, marketing or publicity activities by the Promoter. Any such use by, or on behalf of, the Promoter may occur without acknowledgment, remuneration or compensation to the Winner.
  2. Limit of one entry per person and may only register as an individual.

 

PRIZES AND PRIZE RESTRICTIONS

  1. The Winner will receive the opportunity to meet two Magpies Netball players at the Holden Centre, along with a friend, within 120 days of the end of the Promotion. The total retail value of the prize pool is not more than AU$30. The Prize comprises a money can't buy experience.
  2. The Prize is provided by the Promoter.
  3. The Prize winner must be available for this experience on a date to be determined by the Promoter.
  4. The Prize does not include any travel, accommodation, food or beverages (unless expressly stated).
  5. The Prize is non-transferable and cannot be exchanged, sold or redeemed for cash or used in conjunction with any other offer or promotion. Any prize with a retail value is in Australian dollars and is the recommended retail value as provided by the supplier correct at the time of printing. The Prize is subject to availability. The Promoter accepts no responsibility for any variation in the value of the Prize or if the Prize is damaged or lost in transit. If for any reason, the Prize Winner cannot experience any component of the Prize as confirmed in writing, then that part of the Prize will be forfeited at the Promoter's discretion and the Promoter shall not be liable for any component forfeited.
  6. The Promoter will not be responsible for any costs associated with the use of any Prize. The Winner is responsible for all costs associated with the use of the Prizes including any expenses and costs for travel, accommodation, food or beverages or insurances.

 

NOTIFICATION OF PRIZE WINNERS AND REDRAWS

  1. The Winner will be notified on Monday 16 October at 12.00pm (AEDT) by the Promoter by phone. If a Winner does not respond within three months, another eligible entrant will be randomly drawn as the winner. The Promoter reserves the right to redraw the Prize in accordance with the terms of the original draw, in the event of a winner being unable to satisfy these terms or forfeiting their right to a Prize.
  2. If there are any unclaimed prizes, a prize redraw will be conducted on Monday 15 January 2018 at 3.00pm (AEDT) at the same time and place as the original draw. If a winner is drawn they will be contacted by phone.
  3. All winners will be notified in writing and their names published at magpiesnetball.com.au

 

GENERAL

  1. Subject to the Australian Consumer Law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained, including as a result of the Promoter's negligence, in connection with this Promotion or the redemption or use of the Prizes, except for any liability which cannot be excluded by law. The Promoter accepts no responsibility for any tax implications that may arise from winning the Prize.
  2. Any questions, comments or complaints regarding this Promotion should be directed to the Promoter.
  3. The Promoter shall not be liable for any Prize that may be lost, stolen, forged, damaged or tampered with in any way after it leaves the Promoter’s control.
  4. Subject to the Australian Consumer Law, the Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period or for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times. Entries will be deemed to be accepted at the time of receipt by the Promoter. No responsibility will be taken for lost, late or misdirected entries.
  5. The Promoter's decision in relation to any aspect of the Promotion and Prizes is final and binding on every person who enters and no correspondence will be entered into. Failure by the Promoter to enforce any of their rights at any stage does not constitute a waiver of those rights.
  6. Any Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win and it is within the Promoter's discretion to not display, or remove entries, from social media and the website.
  7. Incomplete, illegible or incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
  8. The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each Entrant and no correspondence will be entered into.

PRIVACY

  1. The Promoter collects personal information about the Entrants to enter them into the Promotion, to conduct and manage the Promotion, to verify their identity and eligibility to enter, to contact the Winners and publish their names and to comply with its legal obligations as the Promoter. The Entrants agree that the Promoter can use and disclose to selected third parties their personal information for further promotional, marketing and publicity purposes. If Entrants do not provide accurate information or their information is not complete or they do not consent to their personal information being used for these purposes, they may not be able to participate in the Promotion.
